TERMS OF USE & TRAVEL CONDITIONS

1. ACCEPTANCE OF TERMS & BINDING AGREEMENT
By accessing www.bespokebookings.co and utilizing the professional consulting and facilitation services of Bespoke Bookings Co. LLC (“Bespoke Bookings,” “we,” “us,” or “our”), you (the “Client,” “Customer,” or “you”) agree to be bound by these Terms and Conditions. This Agreement governs the professional relationship between the Client and Bespoke Bookings. You acknowledge that your use of our website or your “Approval” (via email, text, or digital signature) of any travel proposal constitutes a legally binding electronic signature. If you are making a booking on behalf of other participants, you represent that you have the authority to bind all such participants to these terms.
2. INDEPENDENT INTERMEDIARY STATUS
Bespoke Bookings Co. LLC is a privately owned and operated travel agency.
Intermediary Status: Bespoke Bookings acts exclusively as a Professional Intermediary and consultant. We facilitate the purchase of travel services between the Client and third-party travel suppliers (e.g., airlines, hotels, DMCs).
Limitation of Liability: We do not own, manage, or operate any transportation, accommodations, or travel services. We are not responsible for the acts, errors, omissions, or financial insolvency of any third-party supplier. Your sole legal recourse for service failures, cancellations, or physical injury lies exclusively with the supplier.
3. PAYMENTS, PRICES, & MUTUAL CONSIDERATION
Authorization: You authorize Bespoke Bookings to remit your payment details to suppliers for direct processing.
Merchant of Record: The supplier (e.g., the airline or hotel) is the Merchant of Record.
Price Fluctuations: Prices are subject to change due to seasonal demand, currency fluctuations, or fuel surcharges until full payment is received. Bespoke Bookings is not liable for supplier-initiated price increases.
4. PROFESSIONAL FEES & CHARGEBACK PROHIBITION
Agency Fees: All professional planning, consultation, and booking fees are fully earned at the time the consultation or booking is performed and are strictly non-refundable. These fees compensate Bespoke Bookings for professional expertise and time.
Chargeback Waiver: By utilizing our services, the Client expressly waives any right to dispute or “chargeback” a transaction through their credit card issuer for (a) any non-refundable Bespoke Bookings agency fees, or (b) any supplier service failure. In the event of a supplier cancellation, the Client agrees to seek a refund directly from the supplier or through travel insurance, rather than via a credit card dispute against Bespoke Bookings.
Indemnification for Disputes: If the Client initiates a chargeback against Bespoke Bookings for fees properly earned, the Client agrees to be liable for all costs of collection, including reasonable attorney’s fees.
5. CANCELLATIONS & REFUNDS
Supplier Policies: Specific cancellation terms are provided in your travel proposal. Your approval of a proposal constitutes acceptance of those terms.
Refund Processing: Per U.S. Department of Transportation (DOT) regulations, refunds for air travel must be issued by the Merchant of Record (the airline) to the original form of payment. Bespoke Bookings does not hold these funds and is not responsible for supplier processing timelines.
Wire Transfers: For funds remitted via wire transfer to international DMCs, Bespoke Bookings acts as a pass-through intermediary. Once funds are remitted, Bespoke Bookings is not liable for the recovery of funds should a supplier fail to perform.
6. AIR TRAVEL, DOCUMENTATION, & ENTRY REQUIREMENTS
Flight Monitoring: Airlines reserve the right to change schedules. You must monitor your flight status via the airline’s mobile app.
Identification & REAL ID: You must present a REAL ID-compliant identification for domestic travel.
International Entry: Passports must be valid for 6 months beyond your return date. It is your sole responsibility to secure all required visas and digital authorizations (e.g., ETIAS for Europe, ESTA, etc.).
Biometrics: You acknowledge that many destinations now require biometric screening (facial/fingerprint) as a condition of entry.
7. DUTY TO INFORM & ASSUMPTION OF RISK
Travel involves inherent risks including, but not limited to, health hazards, political unrest, and weather disruptions. It is the Client’s responsibility to monitor U.S. State Department and CDC travel advisories. By booking, you voluntarily assume all risks associated with your travel.
8. DISCLAIMERS & FORCE MAJEURE
“As Is”: Our services are provided without warranties of any kind.
Force Majeure: Bespoke Bookings is not liable for any loss, damage, or delay caused by “Force Majeure” events (e.g., natural disasters, strikes, pandemics, war, or civil unrest).
Liability Cap: To the maximum extent permitted by Texas law, Bespoke Bookings’ total liability shall not exceed the total amount of agency fees paid by the Client for the specific booking in question.
9. GOVERNING LAW, JURISDICTION, & VENUE
Texas Law: This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles.
Exclusive Venue: Any legal suit, action, or proceeding arising out of this Agreement shall be instituted exclusively in the federal or state courts located in Houston, Harris County, Texas.
Waiver of DTPA: To the extent permitted by law, the Client waives all rights under the Texas Deceptive Trade Practices-Consumer Protection Act.
Class Action Waiver: All disputes must be resolved on an individual basis. You waive any right to participate in a class or representative action.
Statute of Limitations: Any claim must be filed within one (1) year after the cause of action accrues.
